Do the chargeback as a "service" chargeback. The issuer will do most the work and there is no consequence if you lose (well you're just back where you started haha). The sooner you issue the chargeback the better and if you have any documentation (forget about the contracts - the business is responsible for providing that evidence) showing how bad it was the better.
